Privacy Policy

This Privacy Policy explains how Gym Ghost ("I," "me," or "my") collects, uses, stores, and protects your personal information when you use the Gym Ghost mobile application ("App"). By using the App, you consent to the practices described in this policy.
1. Information We Collect
1.1 Account Information
When you create a Gym Ghost account, I collect:
- Full name or display name
- Email address
- Account password (stored in encrypted form — plain-text passwords are never stored or visible to me)
1.2 Health & Fitness Data
The App collects fitness data that you voluntarily log, including:
- Workout session details (exercises performed, duration, date and time)
- Sets, reps, and tempo/pace per exercise
- Body weight and lifted weight (if logged post-session)
- Workout streaks, XP points, and session history
- Mascot companion selection (Capy, Bear, or Bird — coming soon)
This data is classified as sensitive health information and is treated with the highest level of protection.
1.3 Technical & Usage Data
I automatically collect limited technical data to operate and improve the App:
- Device type, operating system version, and App version
- App usage patterns (features used, session frequency) — collected in aggregate, anonymized form only
- Crash reports and error logs (no personal data included)
1.4 Data I Do NOT Collect
Gym Ghost does not collect:
- Location or GPS data
- Camera or microphone data
- Contacts or calendar data
- Social media account credentials
- Any biometric data beyond what you manually log
- Any data from children under 13 without verifiable parental consent
2. How I Use Your Data
Your data is used solely to:
- Create and manage your Gym Ghost account
- Provide core App features: session tracking, tempo guidance, XP and streak system, workout history, and — coming soon — mascot interactions and friend challenges
- Sync your data across your devices (coming soon)
- Send you App notifications (streak reminders, milestone alerts, challenge updates) — you can disable these in App settings
- Improve App performance and fix bugs using anonymized, aggregate analytics
- Respond to your support requests
Gym Ghost does NOT:
- Sell your data to third parties
- Use your data for advertising purposes
- Share your data with advertisers or data brokers
- Use your health data to train AI or machine learning models without your explicit consent
3. Health Data — Special Protections
Because Gym Ghost handles fitness and health data, I apply additional protections:
- All health data is encrypted in transit using TLS 1.2 or higher.
- All health data is encrypted at rest using AES-256 encryption.
- Health data is never shared with advertisers, data brokers, or any third party for commercial purposes.
- You can export or delete all your health data at any time from the App settings under "My Data."
If you are located in the European Union (EU) or European Economic Area (EEA), your health data is processed under Article 9(2)(a) of the GDPR — meaning only with your explicit consent. You may withdraw this consent at any time by deleting your account.
4. Friend Challenges & Social Features
If you use the Friend Challenge feature (coming soon), the following limited data is shared with your challenge partner:
- Your display name
- Your XP earned within the challenge period
- Your challenge progress (tasks completed)
This information is only shared with users you explicitly invite to a challenge. You can decline or withdraw from any challenge at any time.
5. Data Sharing
I share your data only in the following limited circumstances:
- Service Providers: Third-party infrastructure providers (e.g., cloud hosting, database services) who process data on my behalf under strict data processing agreements and confidentiality obligations.
- Platform Stores: Apple and Google receive data necessary for App Store and Google Play operations, governed by their respective privacy policies.
- Legal Requirements: If required by applicable law, valid court order, or to protect the safety of users or others from harm.
I do not sell, rent, or trade your personal data under any circumstances.
6. Data Retention
I retain your data for as long as your account remains active. Upon account deletion:
- Account data (name, email) is permanently deleted within 30 days.
- Health and fitness data is permanently deleted within 30 days.
- Anonymized aggregate analytics data (not linked to you personally) may be retained for service improvement.
- I may retain certain data longer if required by applicable law or to resolve disputes.
7. Your Rights
Depending on your location, you may have the following rights regarding your personal data:
- Access: Request a copy of the personal data I hold about you.
- Correction: Request correction of inaccurate or incomplete data.
- Deletion: Request permanent deletion of your account and all associated personal data ("right to erasure").
- Portability: Request your data in a structured, machine-readable format.
- Restriction: Request that I limit processing of your data in certain circumstances.
- Objection: Object to certain types of data processing.
- Withdraw Consent: For health data, withdraw consent at any time by deleting your account.

California Residents (CCPA / CPRA)
If you are a California resident, you have the right to know what personal information is collected about you, request deletion of your personal information, and opt out of the sale of personal information. Gym Ghost does not sell personal information. To submit a request, contact phuctien1997@gmail.com. I will not discriminate against you for exercising your privacy rights.
EU / EEA / UK Residents (GDPR / UK GDPR)
My legal bases for processing your data are: (a) performance of a contract — for account data necessary to provide the App; (b) explicit consent — for health and fitness data; (c) legitimate interests — for anonymized analytics used to improve the App. You have the right to lodge a complaint with your local data protection supervisory authority.
Canadian Residents (PIPEDA)
If you are a Canadian resident, I collect, use, and disclose your personal information only with your consent and for purposes a reasonable person would consider appropriate in the circumstances. You may withdraw consent at any time, subject to legal or contractual restrictions.
8. Children's Privacy
Gym Ghost is not directed at children under 13 years of age. I do not knowingly collect personal information from children under 13. If I become aware that a child under 13 has provided personal data without verifiable parental consent, I will delete that data promptly. If you believe a child has submitted personal data to Gym Ghost, please contact me immediately at phuctien1997@gmail.com.
9. Security
I implement industry-standard security measures to protect your data, including:
- TLS 1.2+ encryption for all data transmitted between the App and servers
- AES-256 encryption for data stored at rest
- Secure, salted, and hashed password storage
- Regular security assessments and dependency updates
However, no method of electronic transmission or storage is 100% secure. While I strive to protect your personal data, I cannot guarantee its absolute security. In the event of a data breach affecting your rights and freedoms, I will notify you as required by applicable law.
10. Third-Party Services
The App may integrate with third-party services. These services operate under their own privacy policies:

11. Changes to This Policy
I may update this Privacy Policy from time to time to reflect changes in the App, legal requirements, or my practices. I will notify you of material changes via an in-app notification or email to your registered address. The "Effective Date" at the top of this policy indicates when the current version took effect.
Your continued use of Gym Ghost after changes become effective constitutes your acceptance of the revised Privacy Policy.

Welcome to Gym Ghost. These Terms of Use ("Terms") govern your access to and use of the Gym Ghost mobile application ("App"), available on iOS (Apple App Store), with an Android version (Google Play Store) coming soon, operated by the individual developer ("Developer," "I," "me," or "my") doing business as Gym Ghost.
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you represent that you have obtained parental or guardian consent. By using the App, you confirm that you meet these requirements.
2. Account Registration
To access certain features of the App, you must create an account by providing your name and email address. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying me immediately of any unauthorized use at: phuctien1997@gmail.com.
I reserve the right to suspend or terminate accounts that violate these Terms.
3. Permitted Use
The App is intended for personal, non-commercial fitness and wellness use. You agree not to:
- Use the App for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or disassemble the App.
- Upload false, misleading, or harmful health data.
- Interfere with or disrupt the App's infrastructure.
- Use automated scripts, bots, or scrapers on the App.
4. Health & Fitness Disclaimer
IMPORTANT: Gym Ghost provides general fitness tools including workout timers, rep counters, tempo guidance, session logging, and gamified progress tracking. It is NOT a medical device, does not provide medical advice, and is not intended to diagnose, treat, cure, or prevent any medical condition.
Before beginning any new exercise program, consult a qualified healthcare professional, especially if you have any pre-existing medical conditions. You use the App entirely at your own risk. I am not liable for any injury, illness, or adverse outcome resulting from your use of or reliance on the App.
5. Subscription & Payments
Gym Ghost currently offers a free tier; a paid Pro subscription is coming soon. When available, subscriptions are processed through Apple App Store or Google Play, subject to their respective terms:
- Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
- You can manage and cancel subscriptions through your App Store or Google Play account settings.
- All fees are non-refundable except as required by applicable law or App Store/Google Play policy.
- Lifetime deal purchases (where available) are non-refundable once redeemed.
- Prices may change with reasonable notice.
For billing disputes, contact Apple Support or Google Play Support directly, as payments are handled by those platforms.
6. Intellectual Property
All content within the App — including but not limited to the Gym Ghost name, logo, mascot characters, XP system, UI design, text, graphics, and code — is owned by or licensed to me and protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
7. User-Generated Content
You may log workout data, session names, and other content within the App. You retain ownership of your content. By submitting content, you grant me a limited license to store and display it solely for the purpose of operating the App on your behalf.
You represent that your content does not infringe any third-party rights and complies with these Terms.
8. Limitation of Liability
To the fullest extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, personal injury, or property damage, arising from your use of or inability to use the App.
My total liability to you for any claims arising out of these Terms or your use of the App shall not exceed the amount you paid me in the twelve (12) months preceding the claim, if any.
9. Indemnification
You agree to indemnify and hold harmless the Developer from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third-party rights.
10. Third-Party Services
The App integrates with third-party platforms including Apple App Store and Google Play for distribution and payment processing. Your use of these platforms is governed by their respective terms and privacy policies. I am not responsible for third-party services.
11. Termination
I may terminate or suspend your access to the App at any time, with or without notice, for conduct that I believe violates these Terms or is harmful to other users, the Developer, or third parties.
Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including Sections 6, 8, 9, and 12.
12. Changes to Terms
I may update these Terms from time to time. I will notify you of material changes via the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the jurisdiction in which the Developer is located, without regard to conflict of law principles. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration or a court of competent jurisdiction in the Developer's location.
